The Committee investigates complaints, holds hearings, makes findings, reports misconduct or disability, and recommends disciplinary action to the Supreme Judicial Court. The committee is not a substitute for an appeal or other remedy in the litigation itself.

The Committee cannot intervene in or change court proceedings or decisions in any way, and it should not be relied on for that purpose.

If you disagree with or wish to contest a ruling in your case it may be appropriate for you to file an appeal.

PURPOSE OF THE COMMITTEE

Any person who has a complaint about a judge’s behavior may seek the assistance of the Committee on Judicial Responsibility and Disability. The Supreme Judicial Court has given the Committee the responsibility to independently investigate alleged violations of the Maine Code of Judicial Conduct by a judge. A Committee investigation may result in either disciplinary action against a judge or a finding that no violation occurred.

The Committee has no authority, however, to become involved in or change the outcome of a court case. A violation of the Maine Code of Judicial Court will not be found if a person is simply dissatisfied with a judge’s decision. A person who seeks a different outcome to his or her case must file an appeal or seek judicial reconsideration in accordance with the applicable rules of court. In addition, a complaint filed with the Committee on Judicial Responsibility does not preserve a person’s right to appeal or seek reconsideration.
